Terms and Conditions – Sawyers Gully Electrical (NSW)
These Terms apply to all goods and services supplied by Sawyers Gully Electrical unless otherwise agreed in writing. By placing an order, signing a quote, paying a deposit, or accepting goods/services, the Customer agrees to these Terms. Conflicting terms in other documents are excluded.
1. Definitions
- Customer: The person or entity ordering goods or services.
- Sawyers Gully Electrical: The service provider.
- Quote: A written price estimate.
- Works: Products, services, or labour provided.
2. Acceptance
Orders are accepted subject to these Terms. Sawyers Gully Electrical may amend these Terms with notice to the Customer.
3. Pricing and Variations
Quotes are valid for 30 days. Prices may change due to errors, delays, or variations requested by the Customer. Deposits may be required and can be non-refundable. Orders may not be cancelled without written approval. Additional charges may apply for variations, delays, or changes to scope.
4. Payment Terms
Payment is due as per invoice or agreed terms. Late payment may incur:
a) Interest at 8.35% p.a. (daily);
b) Recovery of legal/collection costs;
c) Suspension of works.
No deductions or set-offs are permitted for disputed invoices.
5. Delivery & Delays
Delivery and completion times are estimates only. Delays do not justify cancellation or damages. Sawyers Gully Electrical is not liable for delay-related losses.
6. Inspection & Claims
The Customer must inspect goods/services immediately. Claims for defects, damage, or shortfall must be made in writing within 14 days.
7. Risk & Title
Risk passes on delivery. Ownership remains with Sawyers Gully Electrical until full payment is received. Until then, goods are held by the Customer as bailee and must be kept safe.
8. Force Majeure
Sawyers Gully Electrical is not liable for delays or failure caused by circumstances beyond its control, including natural disasters, illness, supply issues, or industrial action.
9. Product Substitution
If specified goods or services are unavailable, reasonable substitutes may be provided without notice.
10. Warranty
Sawyers Gully Electrical warrants its workmanship and materials for 12 months from completion. This excludes misuse, neglect, unauthorised work or lack of maintenance. Warranty claims must be made within 6 months and goods returned within 12. Site inspections outside local area may incur a fee. Liability is limited to repair, replacement or refund.
11. Customer Responsibilities
The Customer must:
a) Confirm scope and provide clear access;
b) Ensure site is ready and safe for work;
c) Acknowledge that incidental property damage may occur.
Delays caused by the Customer may result in additional costs.
12. Termination
Sawyers Gully Electrical may suspend or cancel services if the Customer breaches terms, becomes insolvent or fails to pay. Cancellation costs will be passed on to the Customer.
13. PPSA
The Customer agrees that Sawyers Gully Electrical has a security interest in all goods under the Personal Property Securities Act 2009 (PPSA) and consents to its registration.
14. Privacy
Personal data is collected for business operations and may be disclosed to credit reporting agencies. The Customer consents to this use and disclosure.
15. General
Invalid provisions do not affect the remainder. These Terms are governed by NSW law. Sawyers Gully Electrical is not liable for indirect or consequential loss. Liability is limited to the contract sum. Rights and obligations may be assigned without consent.
